Ministry of Long-Term Care (MLTC) Membership Memo Issued

ONTARIO — This memo is an update to and replacement of the 2015 Clarification of Family Council Membership memo. The 2024 Family Council Membership memo reiterates the importance of Family Councils, lists the powers of a Family Council under the Fixing Long-Term Care Act (FLTCA), and provides an important reminder that “each Family Council is unique and may determine its own role and the responsibilities of its members consistent with the requirements of the FLTCA.”
While the 2024 memo does not contain specific language about continued membership as in the 2015 memo, FCO can assure you that MLTC has not changed its stance on continued membership. Family Councils can still individually determine the appropriateness of the continued membership and participation of Family Council members after the death of a resident, provided that there is no conflict with the requirements in the FLTCA. For example, an individual Family Council could determine that the Family Member of a deceased resident can continue to be a member, even if the family member does not have a relationship with another resident in the home. Councils should include information about continued membership in their Terms of Reference to ensure that all Council members have an understanding of what it entails.
